Addressing Issues

There are always disagreements when it comes to international trading. Whenever there is a contract with an international entity it is important to make sure that the contract is legal and enforceable. This is to always protect the company's best interest.

CadMex Pharma is based in Tampa, Florida and is teaming up with another company called Gentura based in a small country called Candore. The merge of these two will help the business operations of CadMex. The contract between the two companies states that CadMex will license its technology and provide expertise from their employees. In return, Gentua will aid in global marketing rights with the anti-diabetic agent that has been developed.

Because international businesses always have different laws that come from the country itself, it makes it difficult to handle legal disputes between companies. Some practical ways of taking legal action against a foreign business partner that is based in another country are;

1. Discuss all issues involved for resolving the legal disputes in all transactions.

2. Utilize the International business transactions which requires at least a few basic of knowledge about the relevant law and legal systems.

One of the main reasons that the sublicensing agreement could backfire is having Gentura go back on their word or not living up to the standard listed in the contract. When local customs and laws conflict with each of the customs and their affiliated laws for the organization that operates abroad, law will prevail. The reason for this is because a law is just that and is can be fought but unless you have major proof against it, it will prevail.

Legal issues for a company and legal issues for a person will always be different. A company is something that is much larger and much more difficult to overcome with the issues at hand. A person with a domestic issue has more options to solve their problem more quickly.

So needless to say there is a lot about law that needs to be considered whether it is domestic, international, or otherwise.
