Crocket and Tubbs

Mr. Crockett a car collector has been looking for a Ferrari Daytona for many years and one day his dream came true he found the car. Mr. Tubbs had one and Mr. Crockett had to have the car Mr. Tubbs agreed that the price would be $250,000 but during the negotiations, the film Miami Vice was released. In the film Miami Vice was the Ferrari Daytona once it was prominently featured in the movie the demand for the Ferrari Daytona soared and as a result of the demand, the market price was now $500, 00. Mr. Crockett was heartbroken as a result of everything going on Mr. Crockett felt that he was still entitled to the car for $250, 00 because that was the price that he and Mr. Tubbs agreed to. This brings up the question did they have a contract, bill of sale, was it a hand shake deal, or may be a verbal agreement that they had and are the hand shake deal, and the verbal agreement is it like a binding contract. What all is involved in this deal for a Ferrari Daytona let's take a look at what we have to work it out and see if Mr. Crockett still has the right to the car.

I don't see any evidenced of a contract in what little information we have, the bill of sale comes latter and there is no mention of a hand shake deal at all in the story. So what is the meaning of negotiations as it is related to this story negotiations means a discussion intended to produce an agreement so if they are coming to an agreement would that not be like a oral or verbal agreement contract. One Mr. Crockett and Mr. Tubbs have a verbal contract when they were talking about the car a discussing the price of the car they came to an agreement of $250, 00 and that was the piece that they agreed upon and Mr. Tubbs cannot back out on that agreement unless Mr. Crockett agrees on letting him out of the deal. Mr. Tubbs has no legal right to sale that car to anyone else and if he did he would be breaking the law due to the fact that a Verbal Contract is legal and binding and must consist of the 3 elements are offer, acceptance, and consideration. We have what we need to make a verbal Contract but the problem is that verbal contracts are very often very hard to prove, especially if they are very complicated or have no independent witnesses and in the write up of the information and has nothing about a witness being present at the time of the negotiations. Without a witness this will make it hard to prove if either Mr. Crocket or Mr. Tubbs tries to fight the verbal contract that they have, verbal contracts are indeed legally enforceable, but there's a fundamental problem. How do they prove what was agreed upon, that's why written contracts are far more useful, because everything's down in, well,
