Abstract

When getting involved with a company that wants to do a commercial and they want to use an individual in the commercial to advertise their product then that person must sign a legal contract and that person must know the facts of the commercial shoot and the awareness of it as well.

The four elements of a valid legal contract are offer/ acceptance, consideration, mutual decent and subsequent illegality (Dictionary.com, 2011). The Objective theory of a contract is legal concept that a binding agreement exist between two or more parties if a reasonable person would judge (Business Dictionary, 2011). A reasonable person would not accept this as a contract because the jet cost 23 million dollars each and they wouldn't agree with them and there was not a valid agreement this was not a contract it actually was a joke and way beyond and were just advertising in order to make an offer. I think that the court held that there was not a valid agreement here because it was not an offer and that a reasonable person would have understood it made and would not have considered the commercial. Advertising is not considered an offer it is a request to negotiate and that no one can regard them the word that is used are plain and clear and leaves nothing open for negotiation to complete the contract. This case is different from a reward situation because if the plaintiff would have signed the contract and completed the act then the plaintiff would have won the case because the contract would have been legal.
